ATO: Rental income you must declare

State/council based definitions. Example: NSW STRA allows non-hosted entire homes with caps in some areas; other states differ. Check local planning rules.

Short-term lets are legal in Western Australia. A state STRA Register now applies to all hosted and unhosted properties under the Short-Term Rental Accommodation Act 2024. Hosted STRA is exempt from development approval statewide; in the Perth metropolitan area, unhosted STRA can operate up to 90 nights per year without development approval but generally requires approval beyond that threshold. There is no state tourist levy. You must display your STRA registration number in ads and comply with WA smoke-alarm laws (mains-powered alarms for dwellings sold, rented or hired) and normal tax rules.

Legality
Allowed statewide, subject to the state STRA Register, local planning schemes and standard safety/tax obligations.
Night Cap
None statewide. In Perth metro, the 90-night figure is an approval threshold for unhosted STRA (not a cap).
STR Register
Statewide STRA registration is mandatory for all hosted and unhosted listings. Hosted STRA is exempt from development approval statewide; unhosted in Perth metro is exempt up to 90 nights per year but typically needs development approval if exceeding 90 nights. Outside Perth, councils set local planning rules.
Risk
Failing to register, skipping required development approval, or breaching advertising, safety or tax rules can lead to cancellation, fines and council enforcement.

Your Short-Term Rental Compliance Guide

Overview of requirements, authorities, and costs for short-term rental compliance

Enjoy hassle-free hosting with Houst

  • Income tax: include short-stay income in your return.
  • GST: usually not charged on residential rent; only relevant for commercial-residential supplies.
  • State: WA has no extra short-stay levy; government initiatives include a STRA incentive scheme to shift properties to long-term rentals (not a tax).
  • Councils: rating classifications and service charges are set locally.
  • ATO: Renting out your home (income & deductions)

    Edge Cases & Exemptions

    • Perth metro: councils are updating schemes to implement the 90-night DA threshold for unhosted STRA; check your LGA for commencement and local nuances.

    • Regional hotspots (e.g. Busselton/Margaret River): longstanding “holiday home” controls continue, but local registration schemes are inoperative where they duplicate the state register; planning approvals and local conditions still apply.

    • Strata schemes: if by-laws prohibit STRA for a lot, registration can be refused or cancelled.

    Penalties & Enforcement

    • Operating unregistered STRA or advertising without a valid registration number can attract fines up to A$20,000.

    • Councils can issue compliance notices or prosecute for development-approval or condition breaches.

    • Registration may be cancelled if planning approval is absent, conditions aren’t met or strata by-laws prohibit STRA.

    • Platform transactions are reportable to the ATO under SERR; under-reported income can attract interest and penalties.

Up to A$20,000 for operating unregistered STRA or publishing prohibited advertisements under the STRA Act; councils can also penalise planning/local-law breaches.
